疫情下以危险方法危害公共安全罪之认定研析

摘　　要：新冠疫情的特殊背景下,以危险方法危害公共安全罪的入罪应当从严认定,结合《刑法》和“两高”“两部”《意见》的相关规定,细致分析其适格主体、危害行为、危害结果及主观过错等犯罪构成,准确进行认定,不得随意扩张适用。《意见》明确规定该罪的涉疫犯罪主体为确诊病人和疑似病人;确诊病人实施特定的危害行为,足以危及公共安全,则以该罪定罪处罚,而疑似病人属于实害犯,须造成实害后果才能构成该罪;行为人的主观罪过形式为故意系入罪的关键,必须严格区分判断。Under the special background of the epidemic transmission,the conviction of the crime of endangering public security by dangerous means shall be strictly determined.In combination with the relevant provisions of the Criminal Law and the Opinions issued by the Supreme People's Court,the Supreme People's Procuratorate,the Ministry of Public Security and the Ministry of Justice,the people's courts shall carefully analyze the eligible subjects,endangering acts,endangering consequences,subjective faults and other criminal constitutions of the crime,and such crimes shall be accurately determined,and the application thereof shall not be expanded at will.The Opinions clearly stipulate that the subject of the disease-involved crime shall be the confirmed patient and suspected patient;where the confirmed patient has committed certain harmful acts sufficient to endanger the public security,it shall be convicted and punished for the crime;however,the suspected patient belongs to the consequential offense and the crime can be constituted only after causing real harm;the key to conviction is that the subjective fault form of the perpetrator is intentional,so the judicial organ must distinguish the two of them and judge strictly.
