摘　　要：铁路运单是由铁路部门签发的、运输过程中的必要单证,因其不具备物权凭证属性,无法用于信用证结汇与融资,一定程度上限制了货运业务拓展,影响了服务质量提升,特别是在国际铁路联运中,难以充分发挥出铁路运输的优势。在运输市场竞争激烈和贸易市场需求迫切的环境下,通过不断争取国家对铁路运单功能拓展的政策支持,加强与行业之间的广泛合作,利用信息技术手段防范风险,探索总结并推广指导性案例经验,逐步形成铁路运单功能物权化拓展的路径,对创新铁路运输规则、开拓运输市场,促进铁路高质量发展等具有重要意义。Rail waybills are indispensable documents for transportation issued by railway authorities.Because of their inability to function as documents of title,they cannot be used in foreign exchange settlement and financing of letter of credit.This has limited the freight service development and impeded the service quality improvement.Especially in international railway intermodal transport,the advantages of railway transportation have not been brought into full play.In the context of fierce competition in the transportation market and urgent demand of the trade market,we need to strive for government policy supports for the rail waybill function expansion.Extensive cooperation within the industry should be strengthened and information technology can be used to prevent risks.Additionally,we should explore,review and spread guiding cases.In this way,a path can be formed gradually along which rail waybill will be added with the function of document of title.The research is of great significance for the reform of railway transportation rules,exploration of new transportation markets and the high-quality railway development.
