总体国家安全观的刑法实践理性思考

摘　　要：国家安全是随着这个国家所处历史时代而发展变化的,新时代因应复杂国际环境和我国国家安全面对的新情况,总体国家安全观应运而生,成为了治国理政的重大原则。总体国家安全观重在从总体上考量国家安全,强调系统整合的思维方法,具有显著的时代性、系统性和辩证性。同时,我国刑法历来重视国家安全立法,形成了从反革命罪到危害国家安全罪的嬗变。当前,刑法实践之于总体国家安全观的内嵌,应为刑事政策的法律化,关键是合理明确刑法中总体国家安全,在价值导向上应反映现实需要、体现系统整合和契合刑罚预防观念以证其正当性;同时在制度构建上,应以危害国家安全罪为核心,协调相关国家安全的立法,并完善条文以填补立法疏漏。national security develops and changes with the historical era that this country is in.In the new era,in response to the complex international environment and the new situation that our national security is facing,the overall concept of national security emerges as the times require,became a major principle of governance.The overall national security concept focuses on the overall consideration of national security and emphasizes the thinking method of system integration,which is characterized by epoch,systematicness and dialectics.At the same time,China’s Criminal Law has always attached great importance to national security legislation,forming a change from counter-revolutionary to crimes against national security.At present,the embedding of criminal law practice in the overall national security concept should be the legalization of criminal policy.The key is to reasonably define the overall national security in Criminal Law,on the value orientation,it should reflect the actual needs,embody the systematic integration and conform to the concept of penalty prevention to prove its legitimacy,and on the system construction,it should take the crime against national security as the core,and coordinate the relevant national security legislation,and improve the provisions to fill the legislative omissions.
