摘 要:民间金融作为正规金融的补充在经济社会中发挥了重要作用,所以其规制也是一个值得重视的现实课题,推动民间金融规制朝向金融治理现代化转型正当其时。根据国家治理现代化的要求,民间金融规制应该秉持权利本位和风险控制的二元立场,并通过规制理念、规制体系、规制工具的法治化来实现。反观当前的规制实践,由于"金融抑制"的传统影响,民间金融规制依赖于司法规范和地方性规范,司法主导模式突出,规制效果不理想。未来的民间金融规制应该致力于规制理念的革新、规制体系的完善以及规制工具的法治化转型。As a supplement to formal finance,informal finance plays an important role in the economic society.Therefore,its regulation is also a realistic issue worthy of attention. It is time to promote the regulation of informal finance towards the modernization of financial governance. According to the requirements of the modernization of national governance,the regulation of informal finance should adhere to the dual position of standard of right and risk control and be realized through the legalization of regulatory concepts,regulatory systems,and regulatory tools. In contrast to the current regulatory practices,due to the traditional influence of “financial repression”,informal financial regulation relies on judicial regulations and local norms,the judicial dominant model is prominent,and the regulatory effect is not ideal. In the future informal financial regulation,the emphasis should be attached to the innovation of regulatory concepts,the improvement of regulatory systems,and the legal transformation of regulatory tools.
