对象编辑与有效监管:基于政府治理序列转换个案的考察

摘　　要：有效的政府监管涉及"具体监管行动的有效展开"和"前监管环节政府干预"两个部分。对象编辑乃是前监管环节政府干预的主要方式。对象编辑的作用点是行业形态和内容而非主体资质和行为。简言之,"对象编辑=形态编辑+内容编辑"。依据形态和内容编辑"度"的取舍,可将"对象编辑"划分为"强形态-强内容""强形态-弱内容""弱形态-强内容"以及"弱形态-弱内容"对象编辑等四种基本类型。对象编辑旨在从塑造"合格的监管对象"的角度为具体监管行动的有效展开确立有效"抓手"。就其功能来讲,对象编辑既有助于政府治理序列转换与分流,亦可以在同一政府治理序列内推动治理优化和进阶。知识界关于中国特色政府监管及其创新的研究需要重视对象编辑,以构建更加完整的政府监管知识体系。Effective government regulation involves both two parts:"effective implementation of specific regulatory actions"and"government intervention in the pre-regulatory stage"."Object editing"is the main form of government intervention in the pre-regulatory stage.Object editing works on the form and content of industry rather than on the qualification and behavior of the subject.In short,"object editing=form editing+content editing".Depending on the"degree"of form and content editing,object editing can be divided into four basic types:"strong form-strong content","strong form-weak content","weak form-strong content"and"weak form-weak content".The purpose of object editing is to create"qualified regulatory targets"for the regulators.In term of its function,object editing can help to shift and divert the government governance sequence,as well as to promote governance optimization and advancement within the same governance sequence.In order to build a more complete knowledge system of government regulation,the intellectual circles should pay attention to the object editing in the research on Chinese government regulation and its innovation.
