夫妻忠诚协议的性质及其对内效力——基于社会关系“泛”契约化的一般认识

摘　　要：社会关系“泛”契约化是我国当前社会文化变迁的重要方向,夫妻忠诚协议的出现和流行某种程度上正是这一社会文化运动在婚姻家庭领域的具体化。限于相关规范的欠缺和传统形式主义观点的束缚,相关司法实践和理论研究对忠诚协议的对内效力多持保守态度。通过考察形式主义和实用主义法哲学的基本观点,将其用于对不同类型忠诚协议效力的考量,作出体现社会文化变迁而又不违反基本婚姻伦理和法律制度的解释。无论是财产型还是人身型忠诚协议,只要不具有显然违法和侵犯人身权的情形,法律就应认可其效力并为其寻求在现行法律体系内合理的生存空间,这本质上是意思自治原则扩大适用于婚姻家庭法领域。财产型忠诚协议的财产属性较强,应赋予其典型民事合同的效力;人身型忠诚协议的财产属性较弱而伦理属性较强,将其作为一种以特殊的债的产生为后果的民事法律事实,有限承认其效力更为妥帖。The pan-contract of social relations is an important direction of the current social and cultural changes in China.To some extent,the emergence and popularity of marital loyalty agreement is the embodiment of this social and cultural movement in the field of marriage and family.Due to the lack of relevant norms and the constraints of traditional formalism,relevant judicial practice and theoretical research are mostly conservative about the internal effectiveness of loyalty agreements.By examining the basic viewpoints of formalism and pragmatism legal philosophy,this paper applies them to consider the validity of different types of loyalty agreements and makes an explanation that reflects the social and cultural changes without violating the basic marriage ethics and legal system.No matter it is property or personal loyalty agreement,as long as there is no obvious violation of law and violation of personal rights,the law should recognize its effectiveness and seek a reasonable living space in the current law system,which essentially means that the principle of autonomy is extended to the field of marriage and family law.The property loyalty agreement has strong property attribute,so it should be given the effect of typical civil contract.The property attribute of personal loyalty agreement is weak,but the ethical attribute is strong,so it is more appropriate to take it as a kind of civil legal fact with the consequence of the generation of special debt,and its validity should be limited.
