摘 要:学者们对于"司法公信力"的含义和本质属性的解读可以归纳为客观说、主观说和混合说三种类型。从文义解释、目的解释、我国国家性质的要求以及"司法公信力"一词的渊源等角度考虑,采用主观说较为妥当。司法公信力的主观属性决定了主观指标在司法公信力评估体系中的重要地位,司法公信力评估应当全部采用或者主要采用主观指标。司法公信力评估并不排斥客观指标的应用,但要把握好主次关系,防止客观指标的滥用和误用。基于司法公信力的主观属性,司法公信力评估的目的是了解"社会公众对司法信不信",而不是"司法工作好不好",司法公信力的高低是多元因素叠加影响的结果。Scholars’ interpretation of the meaning and essential attribute of "judicial credibility" can be summarized into three types: objective theory, subjective theory and mixed theory. From the perspectives of literal interpretation, purpose interpretation, the requirements of the state nature of China and the origin of the word "judicial credibility", it is more appropriate to adopt the subjective theory. The subjective attribute of judicial credibility determines the important position of subjective indicators in the judicial credibility evaluation system, thus we should exclusively or mainly adopt subjective indicators for the judicial credibility evaluation. The evaluation of judicial credibility does not reject the application of objective indicators, but we should handle well their relationship with subjective ones in terms of position to prevent their abuse and misuses. Based on the subjective attribute of judicial credibility, the purpose of its evaluation is to understand "whether the public believes in justice" rather than "whether the judicial work is good". The level of judicial credibility is the result of the superposition of multiple factors.
