警察权威的本质探析

摘　　要：警察权威的本质包括五方面的内涵,即警察权威表现为一种警察命令与公众服从之间的关系,而在两者之间,公众的服从是重点,其决定了警察权威的存在;警察权威的来源必须是合法性的或曰符合客观规律的,虽然对所谓的合法性和规律性的认知有一个过程,是一个渐进的过程,但这不能成为警察权威也可以来源于非法的或违反客观规律的理由;警察权威是一种公众被强制或自愿下的克服了抵抗的服从;警察权威是警察权力的实施效果之一,但绝不是警察权力本身,警察权威与警察权力分属于不同层次的范畴;公众服从警察权威是源于人们对于秩序的需要而让渡个人自由,警察权威的价值追求是实现社会秩序下的个人自由。The essence of police authority includes five aspects:Police Authority is the relationship between police order and public obedience,in which public obedience is the key,which determines the existence of police authority;The source of police authority must be legitimate or conform to objective laws,although the so-called legitimacy and regularity of recognition has a process,is a gradual process,but this cannot be the reason that the police authority can also come from illegal or violating the objective law;the police authority is a kind of obedience that the public is forced or voluntary to overcome the resistance;the police authority is one of the enforcement effects of the police power,but it is not the police power itself,the police authority and the police power belong to different levels of category;the public obeys the police authority is derived from people's need for order and surrenders individual freedom,the value pursuit of police authority is to realize individual freedom under the social order.
