外籍犯社区矫正存在的问题及对策

摘　　要：随着中国对外开放的程度和城市国际化步伐的加快,外国人来中国的数量与日俱增。在各国人员频繁流动带来经济发展的同时,外国人成为犯罪主体的案件日益增多,也引起了公众对外国人在华犯罪的关注和担忧。长期困扰西方发达国家的外国人犯罪问题正在加速向中国转移。社区矫正制度是由西方提出的刑罚制度,在我国是指针对被判处管制、宣告缓刑、裁定假释、暂予监外执行的这四类犯罪行为较轻的对象所实施的非监禁刑矫正刑罚或考验。制定该制度的目的是为了避免和克服监禁刑存在的某些弊端,使刑罚执行服务于罪犯再社会化,能够最大限度地预防和减少犯罪、化解社会矛盾、维护社会和谐稳定。我国的社区矫正制度至今已经经历了18年的发展完善,对于社区矫正制度问题的梳理以及找到阻碍其发展的原因,找到解决的方法是理论界与实务部门需要共同承担的时代使命。不过,社区矫正制度对外籍犯适用的整个过程中存在一定的困难,需要相应的解决方法,从实际来看,由以下几方面因素构成。通过对外籍犯的发展趋势以及所出现的问题进行分析发现,外籍犯罪在我国存在犯罪人数急剧上升,犯罪团伙增多,法律监督体系不完善,社区矫正工作人员选拔程序尚不够完善。外籍犯对于社区矫正的突出问题包含以下几个方面:外籍犯在语言上存在障碍,志愿者工作在一定程度上形同虚设,社会力量一直以来也是处在薄弱环节,对于外籍犯社区服刑人员的管理重视并不明显。导致这些问题存在的原因有:外籍犯未经合法手续而在中国非法就业、非法入境和非法居留的"三非"问题突出,外籍犯对中国法律认识不够,监管制度以及矫正制度在中国存在突出问题。针对问题所在,对于外籍犯社区矫正的完善措施,首先要设置特殊化的外国籍社区服刑人员矫正制度,�With the higher and higher degree of China’s opening up to the outside world and the accelerated pace of urban internationalization, the number of foreigners coming to China is increasing day by day. While the frequent movement of people in various countries brings economic development, the number of cases in which foreigners become the subject of crimes is increasing day by day, which has also aroused public concern about foreigners committing crimes in China. The problem of crimes committed by foreigners, which has long plagued western developed countries, is accelerating its transfer to China. The community correction system is a penalty system put forward by the West. In China, it refers to the non-prison correction punishment or test for the relatively slight crimes, which are sentenced to control, probation, parole adjudication, and temporary execution outside prison. The purpose of this system is to avoid and overcome some disadvantages of imprisonment, to make penalty execution serve the re-socialization of criminals, to prevent and reduce crimes to the maximum extent, to resolve social contradictions, and to maintain social harmony and stability, which is of great significance. The community correction system in China has been developed and perfected for 18 years. To sort out the problems of the community correction system and find out the problems that hinder the development,finding a solution is the mission of the times and also the one that the theorists and practical departments need to undertake together. Studying the present situation of foreigners’ crimes and community correction of foreign criminals in China aims to analyze the development trend and causes of foreign criminals. In fact, the number of foreign criminals committing crimes in China has increased sharply and the number of criminal gangs has increased. But the legal supervision system is not complete and the selection procedures of staff for handling foreign criminals are not perfect. The reasons for these problems are: the "three-
