医养结合养老模式下老年人权益保障的法律问题探究

摘　　要：医养结合养老模式是中国当前人口老龄化问题的主要应对方式之一,需要在严格的法律监督保障中落实,以保证最大限度地维护老年人的身心健康,保障老年人的合法权益。医养结合养老模式下老年人权益保障存在养老机构不具备办医资质、养老医院不能在全国范围内普及等问题。从法律实施层面对医养结合问题进行分析时发现存在没有符合当前医养结合养老模式的法律处理制度、因医养结合养老模式的复杂性使法律监督无从实现等问题。建议建立专门的老年人医养结合养老模式下法律权益保障机构、完善医养结合养老模式下老年人权益保障的法律法规、通过老年人普法和社会监督加强医养结合养老模式的法律监督等方面来解决医养结合养老模式下老年人权益保障的法律问题。The medical-nursing combination is one of the main ways to solve the current problem of aging population in China,which needs to be implemented in strict legal supervision and security to ensure the maximum protection of the physical and mental health of the elderly and protect their legitimate rights and interests.There are some problems in the protection of the rights and interests of the elderly under the mode of combining medical care with nursing care,such as the fact that nursing institutions are not qualified to run hospitals and nursing hospitals cannot be popularized nationwide.This paper analyzed the problems of the combination of medical care and elderly care from the perspective of legal implementation,and found that there is no legal treatment system in line with the current combination of medical care and elderly care model,and the complexity of the mode makes it impossible to realize legal supervision.It is suggested that to solve the legal problems of the protection of the rights and interests of the elderly from multi-aspect,such as the establishment of the specialized institutions for protecting the legal rights and interests of the elderly under the mode of medical-nursing combination,the perfection of rights protection laws and regulations under the mode of medical combination of old age pension mode,the strength of legal supervision of the mode of combining medical care with old-age care through law popularization and social supervision.
