摘　　要：传统个人信息保护经历了人际信任向制度信任的转变,但人际信任或制度信任难以应对大数据背景下个人信息保护的信任危机。区块链技术以去中心化、共识机制、安全高效等技术特性化解了该危机,这在本质上基于区块链所提供的技术信任,是个人信息保护信任范式的又一次转变。然而,区块链技术与个人信息保护有暗合相通的一面,也有冲突抵牾的一面,兼顾区块链技术的发展与个人信息的保护是两者融合的基点所在,并树立“技术—法律”二元互动的融合型治理理念。在融合型治理理念下,我国立法应当明确哈希化个人信息的性质,结合区块链技术明晰个人信息具体权利的内涵与外延,通过具体规定与一般补充的方式廓清相关义务主体,确保区块链下的个人信息保护行稳致远。Traditional personal information protection has experienced the development from interpersonal trust to institutional trust,but it is hard for interpersonal trust or institutional trust to deal with the trust crisis of personal information protection under the background of big data.Blockchain technology resolves the crisis with technical features such as decentration,consensus mechanism,and safety and efficiency,which is technology trust in essence provided by blockchain and a transformation in trust paradigm of personal information protection.Although blockchain technology agrees with personal information protection,they are also in conflict with each other;thus,consideration to both the development of blockchain technology and the protection of personal information is the key point for their integration,and we should adopt the idea of integrated governance of“technology-law”interaction.To follow the idea of integrated governance,we should clarify the nature of hashed personal information,the connotation and denotation of specific personal information rights with the help of blockchain technology,and the related duty entities through specific stipulations and general amendments so as to ensure the steady and sustained development of personal information protection under blockchain technology.
