关于延迟退休立法问题研究--以退休的法律性质为视角

摘　　要：退休究竟属于权利还是义务,该性质的认定对于如何设计社会各工种群体的延迟退休政策有着重要影响。人口老龄化问题、不同工种基本养老保险金差异大、超龄再就业群体维权难等状况逐步掣肘我国经济的稳步运行。早年我国就出现制定延迟退休办法的呼声,但我国人口多、关系复杂的情况使得该政策的制定迟迟不能问世。寻找适合我国国情的延迟退休方式,首先应当明确退休的法律性质,以其性质为基点设计社会各行各业延迟退休机制。本文将通过比较分析退休的法律属性,结合正义二原则理论提出适用于我国国情的延迟退休制度的框架性意见。Whether retirement is a right or an obligation,the determination of this nature has an important impact on how to design the postponement of retirement policies for various work groups in society.The aging of the population,the large difference in basic pension insurance for different types of work,and the difficulty of the rights of over-aged re-employment groups have gradually hindered the steady operation of my country's economy.In the early years,there were calls for delaying retirement measures in China,but my country has a large number of people and complicated relationships.The formulation of this policy has been delayed.The author believes that to find a way to delay retirement suitable for my country's national conditions,we should first clarify the legal nature of retirement,and design the delayed retirement mechanism for all walks of life in society based on its nature.This article will compare and analyze the legal attributes of retirement,combined with the theory of the two principles of justice,and put forward the framework opinions of the delayed retirement system applicable to my country's national conditions.
