摘 要:随着司法实践的不断发展变化,农药药害行政鉴定意见的概念开始进入司法领域。由于对此证据适用缺乏统一具体的法律规则和审查判断方法,导致无论在理论上还是实践中对此证据的属性问题讨论不断,处理方式各异。证据属性需要结合具体意见内容进行分析,不能一概而论。建议在司法审查方面,通过合法性、关联性和客观性进行审查并辅之以行政鉴定人出庭、司法技术咨询等方法。立法方面,亟需制定农药药害行政鉴定规范,统一文书名称格式,完善质证程序保障。With the continuous development and change of judicial practice,the concept of administrative appraisal opinions on pesticide damage has begun to enter the judicial field.The lack of uniform and specific legal rules and review and judgment methods for the application of this evidence has led to constant discussions on the nature of this evidence in both theory and practice,and different handling methods.Evidence attributes need to be analyzed in conjunction with specific opinions and cannot be generalized.It is recommended that,in terms of judicial review,review through legality,relevance and objectivity,supplemented by methods such as the appearance of administrative appraisers and judicial technical consultation.In terms of legislation,there is an urgent need to formulate regulations for the administrative identification of pesticide damage,unify the document name format,and improve the guarantee of cross-examination procedures.
