摘 要:行政案件诉讼审理的复杂性在于案件类型多样化,因此所援引的法律规范偏向于原则性、概括性、程序性规则,这也容易造成"类案异判"的弊端。为此,在诸多案例中发现相似点可以有效解决该问题。但是,相似点如何选择面临的最大困境是样本范围选择、归类标准确定等不确定问题。而运用大数据及其核心的相关性分析方法可以解决这些不确定问题,从而为行政诉讼案件的"类案同判"提供科学可靠的基础。The complexity of administrative litigation trial lies in the variety of cases,so the legal norms cited tend to be principle-based,general-based and procedural rules,which is also easy to cause the malpractice of"different judgment in similar cases".Therefore,finding similarities in many cases can effectively solve the problem.However,the biggest difficulty in how to select similarity points is the uncertain problems such as sample range selection and classification standard determination.The use of big data and its core correlation analysis method can solve these uncertain problems,so as to provide a scientific and reliable basis for the"similar cases of the same judgment"of administrative litigation cases.
