我国行业协会自律与市场监管体制改革关系论

摘　　要：我国的市场监管体制正在进行深度调整,行业协会自律管理是市场监管体系中的重要内容。行业协会作为维护和增进特定行业市场主体共同利益的自律性组织,应当将其定位为私法性组织。行业协会具有共益性、自律性和自治性,其进行行业自律管理具有信息优势、专业优势和成本优势,有利于监管范围的更广覆盖和克服政府失灵。目前我国的行业协会自律管理存在法律规范不完善、行业协会管理体制没有理顺、行业协会内部治理机制不健全、行业协会对特定市场影响力有限等问题。在我国新一轮市场监管体制改革中,引导行业协会实质性参与行业标准制定可以作为改革的有形抓手,理顺行业惩戒与行政处罚的关系可以作为改革的重要方向。The market supervision system of China is undergoing in-depth adjustment,and the self-discipline management of trade associations is an important part of the market supervision system.As a self-regulatory organization that maintains and promotes the common interests of market entities in a specific industry,industry associations should be positioned as private legal organizations.Industry associations have common benefits,self-discipline and autonomy.Selfdiscipline management has information advantages,professional advantages and cost advantages,which is conducive to wider coverage of supervision and overcoming government failures.At present,the self-discipline management of industry associations in China has problems such as imperfect laws and regulations,unorganized management system,imperfect internal governance mechanism,and limited influence on specific markets.In the process of reform of China’s market supervision system,guiding industry associations to substantively participate in the formulation of industry standards can be a tangible starting point for reforms,and straightening out the relationship between industry punishments and administrative penalties can be an important direction for reforms.
