试探我国卫生行政裁量说明理由制度的问题与完善

摘　　要：说明理由制度在我国已确立起,但其还有诸多问题。本文就卫生行政裁量说明理由制度而分析涉及该制度的法律法规、规范性文件、执法案例、裁判文书,再结合执法实践,剖析该制度所存在的问题及其原因,提出相应具体完善内容,和该行为说明理由的过程要点及其审查要点,以发挥该制度制约和规范行政裁量权、维护行政相对人及利害关系人合法权益的作用。The system of justification has been established in China,but there are still many problems.Starting from the health administrative discretion justification system,this paper analyses laws and regulations,normative documents,law enforcement cases and judgment documents related to this system,analyzes the existing problems of the system and its reasons by combing with law enforcement practice,and puts forward the corresponding specific content for improvement,and the justification process points and review key points,so as to play the system's role of restricting and standardizing the administrative discretion,safeguarding the legal rights and interests of administra⁃tive counterparts and interested parties.
