摘 要:有关恐怖活动的规制,《刑法》和《反恐怖主义法》在法律术语、管辖、违法犯罪认定、责任追究等方面均存在较大冲突,不仅导致行刑衔接不畅,还冲击刑法的逻辑自洽性。造成这一问题的直接原因是《反恐怖主义法》与《刑法》立法目的的差异,主要原因是反恐刑事立法的介入早期化,根本原因是我国单一化的反恐刑事立法模式。有必要从立法模式、刑事政策、体系协调三个层面重新审视我国构建反恐单行刑法的必要性和可行性,制定出有效衔接《反恐怖主义法》和《刑法》的反恐单行刑法,更好地预防和惩治恐怖活动犯罪。Regarding the regulation of terrorist activities,the Criminal Law and the Anti-Terrorism Law have great conflicts in terms of legal terminology,jurisdiction,identification of illegal crimes,and accountability,which leads to poor connection between executions and impacts the logic of the criminal law.The direct cause of this problem is the difference between the legislative purposes of the Anti-terrorism Law and the Criminal Law.The main reason is the early intervention of the anti-terrorism criminal legislation,and the fundamental reason is the simplification of the anti-terrorism criminal legislation model in my country.It is necessary to reexamine the necessity and feasibility of China's establishment of a single anti-terrorism criminal law from the perspective of legislative models,criminal policies,and system coordination,and formulate a single anti-terrorism criminal law that effectively links the Anti-terrorism Law and the Criminal Law to better prevent and punish Terrorist crimes.
