摘  要:博物馆进行商标异议的主要目的在于维护博物馆商标的显著性,打击近似商标或其他对博物馆商标权益构成妨碍的商标。相比商标无效宣告等维权途径,商标异议有其特殊的优势。博物馆对不当商标提起异议,主要法律依据包括《中华人民共和国商标法》中关于“申请在先”“驰名商标保护”“在先权利”“不良影响”“恶意抢注”等内容的规定,相应的证据涉及博物馆作为异议人的主体资格证明、博物馆商标知名度证明、对方恶意抢注的证明、可能被异议商标造成不良影响的证据材料等。The main purpose of trademark opposition by museums is to maintain the distinctiveness of museum trademarks and to fight against similar trademarks or other trademarks that pose obstacles to the museum’s rights and interests.Trademark opposition has its own special advantages over the invalidation of trademarks and other ways of defending rights.The main legal basis for a museum to oppose an improper trademark includes the provisions of the Trademark Law of the People’s Republic of China regarding“prior application”,“protection of well-known trademarks”,“prior rights”,and“adverse effects”.The correspon⁃ding evidence involves the proof of the main qualification of the museum as the opponent,the proof of the vis⁃ibility of the museum’s trademark,the proof of the opponent’s malicious infringement,and the evidence of the possible adverse effects of the opposed trademark.
