摘 要:随着海底勘探技术的不断发展,国际海底资源勘探活动日渐繁盛,相关争端也随之增加。为提高国际海底资源勘探开发活动争端解决的效率和专业性,国际海底管理局曾在《“区域”内矿产资源开发规章草案》中创新地提出了“审查机制”。然而,近年来有关“审查机制”的讨论逐渐湮灭。原因在于,该项制度设计虽以效率和专业性为重,但实际上却部分背离了《联合国海洋法公约》的精神。于中国而言,国际海底资源勘探开发活动的争端解决制度创新是建设“海洋命运共同体”,实现“海洋强国”的应然关切,“审查机制”酝酿的理由及其夭折的原因理应成为我国积极参与国际海底制度建设的有益鉴戒。With the continuous development of seabed exploration technology,the international seabed resources exploitation activities are flourishing and the related disputes are increasing as well.In order to improve the efficiency and professionalism of the dispute settlement system for international seabed resource exploitation activities,the Authority has proposed a Review Mechanism in the Regulation on Exploitation of Mineral Resources.However,discussion of the Review Mechanism has faded recent years.The reason is that the system,though designed to be efficient and professional,is in fact partly contrary to the spirit of the Convention on the Law of the Sea.As far as China is concerned,the system innovation of dispute settlement in international seabed exploitation activities is due concern of the construction of maritime community with a shared future,and the reasons for the brewing and early failure of the Review Mechanism should be the beneficial experience for China to actively participate in the construction of international seabed institutional system.
