摘　　要：人工智能的法律人格问题在国内外法学界一直是悬而未决的问题。近年来发生的关于人工智能生成产品的著作权归属问题以及自动驾驶侵权责任等问题更是引发了法律界对于人工智能法律人格的审视。虽然目前整体上偏向于否定其法律人格,但是综合赋予人工智能法律人格的正当性及必要性分析,认为应当在对其进行类型化分析的基础上赋予其有限的拟制法律人格,并规定相应的管理规则,明确权利义务规范,制定伦理和法律相结合的调控体系,以期实现科技与法律的协调发展。The legal personality of artificial intelligence has always been an unresolved issue in the legal circles at home and abroad.In recent years,the issue of copyright ownership of artificial intelligence-generated products and the liability for infringement of automatic driving have triggered a review of the legal personality of artificial intelligence in the legal community.Although the current overall preference is to deny his legal personality,the comprehensive analysis of the legitimacy and necessity of giving artificial intelligence legal personality believes that it should be given limited fictitious legal personality on the basis of typological analysis,and stipulate corresponding management rules,clarify rights and obligations,and formulate a regulatory system that combines ethics and law with a view to achieving coordinated development of technology and law.
