摘　　要：土地、山林、水利权属纠纷作为农村社会治理的三大类案件,存在案件数量多,纠纷化解难;涉及人员多,事实查清难;政府确权时对管理使用现实重视不够;复议前置纠错功能未有效发挥等问题。究其原因,主要是我国土地、山林、水利制度前后历经土地改革、合作化与人民公社化、四固定、林业三定、林业改革等多次变革,历史遗留问题多。本文以最高人民法院第一巡回法庭对其辖区三类案件的裁判为研究对象,对三类案件的概念含义、处理途径、审理原则、起诉条件判定、证据效力审核、法律法规适用等问题进行实证分析,以期为行政机关和司法机关正确处理类似案件提供决策依据与裁判思路。Land,forest and water conservancy ownership disputes are the three major types of cases in rural social governance.There still exist many issues.The large number of cases makes it difficult to resolve disputes;too many people involved makes it difficult to find out the facts;the government does not pay enough attention to the reality of resource management and usage when confirming rights.The main reason is that China's land,forest and water system has undergone many changes such as land reform,co-operation and communalization,four fixed,three fixed forestry,and forestry reform before and after,and there are many problems left over from history.This paper takes the judgments of the First Circuit Court of the Supreme People’s court on the three types of cases in its jurisdiction as the research objects,for empirical analysis of the concept of the three types of cases,the handling approaches,the trial principles,the judgment of the prosecution conditions,the examination of evidence effectiveness,and the application of law and regulations.In order to provide decision-making basis and suggestions for adjudication for administrative agencies and judicial agencies to correctly handle similar cases.
