枢纽脱嵌:农村政策试点中违法案件的行为特征与逻辑归因

摘　　要：推进乡村振兴战略,离不开合法有序的政策试点。分析392个农村政策试点中的分析违法案件,发现相关违法行为主要由在试点过程中充当枢纽中介角色的基层治理者实施,试点实践“带头人”集体违法现象突出,违法方式主要体现为试点过程中权力寻租谋取私利,侵害国家财产和他人利益,对试点过程及其目标实现造成严重影响。与试点中违法行为所造成的恶性结果相比,目前对相关行为处分总体较轻,未能将违法行为影响与导致试点失败、失误的结果联系起来,未能体现出试点中违法行为危害的特殊性。政策试点中违法行为出现的根本原因在于“枢纽脱嵌”,即基层治理者出于私利而在试点过程中不有效履行联结高层级政府与基层群众的枢纽职能,阻截治理需求与治理资源之间的关联,通过各种方式截留试点资源、消解试点需求,最终导致试点项目无法达成实效。要有效防止基层政策试点中违法风险的爆发,关键在于试点权力的“回嵌”,从而建构起试点权力制约的规范路径。To promote the strategy of rural revitalization,legal and orderly pilot reform weighs too much.This paper,through the analysis of 392 illegal cases in the pilot reform of rural policies,finds that the relevant offenses are mainly committed by the primary level heads who act the hub intermediary role in the pilot process;some offenses involve in the group who takes the leading role in the practice,an phenomenon which stands out for the power rent-seeking for private interests has resulted in the infringement of state property and others’interests,hence a serious impact on the pilot practice and the realization of its objectives.The punishment,however,weighs less when comparing with the malignant results thus produced,and the impact is not fully connected with the results,thus shadowing the particularity of the harm.The root lies in the“hub disengaging”,that is,the grass-roots heads,for their own benefits,do not well perform the hub function to knot the high-level governments with the primary-level ordinaries;instead they intercept the pilot resources and eliminate the pilot needs in various ways,thus resulting in a failure of the pilot project.To prevent the outbreak of illegal risks in the pilot reform,the key lies in the back embedding of pilot power so as to construct a standardized path of pilot power restriction.
