摘　　要：建设体育强国需要强大的法治保障、推进健康中国战略需要法治规范引导、全面依法治国应补齐体育法治短板、坚持在法治轨道上推进体育治理体系现代化构成了中国体育法治建设的战略背景。体育法治要服务于体育发展战略大局、体育法治要为体育深化改革保驾护航、体育法治要与体育政策良性互动、体育法治要融入体育治理过程指引了中国体育法治建设的战略走向。在全民健身、学校体育、竞技体育、体育社会团体、体育产业等体育强国建设的重点领域,对法治的需求日益强烈,亟待补齐当前体育法治发展的短板。由此,应充分利用当前《体育法》修改契机,在外部充分接入社会主义法律体系,在内部充分完善体育法律规范体系,以重点领域为突破口,完善中国体育法治建设,为体育治理体系和治理能力现代化的实现提供制度支撑。Strong legal guarantee is needed to build a strong sports country,and normative guidance of the rule of law is needed to promote a Healthy China strategy;the shortcomings of sports rule of law needs to be made up for considering the comprehensive ruling of the country by laws,and promoting the modernization of sports governance system needs to adhere to the track of rule of law,and these constitute the strategic background of China's sports rule of law construction.The strategic trends of the construction of sports rule of law in China should be as follows:sports rule of law should serve the overall sports development strategy,and it should escort the deepening reform of sports;also it should interact with sports policy,and finally it should be integrated into the process of sports governance.In the key areas of national fitness,school sports,competitive sports,sports social organizations,and sports industry,there is an increasing demand for the rule of law,which is urgent to break through the current obstacles.Therefore,we should fully integrate into the socialist legal system externally and improve the sports legal norm system internally when"Sports Law of the People's Republic of China"is being revised,with the key areas as breakthrough points to improve the construction of the Chinese sports legal system,and provide institutional support for the sports governance system and the realization of modernization of governance capabilities.
