摘　　要：《国防动员法》自2010年颁布至今已有10余年发展历程。《国防动员法》的颁布实施使中国国防动员工作全面步入法治轨道,进一步完善了国防动员法规体系,规范了国防动员权的行使,保障了公民的合法权益。但伴随着中国经济社会的快速发展,《国防动员法》已经表现出明显的滞后性,规范性、指导性不足,与军队改革后的体制不相适应、需求提报程序不规范、补偿规定不明确等问题已经不适应中国国防动员体系的建设。因此,加快《国防动员法》修订是国防动员改革和发展的当务之急,修法工作要紧紧围绕军民融合发展战略、统筹贯彻总体国家安全观与应急管理体系相衔接,与法治政府建设同步推进,以因应国家治理体系和治理能力现代化的需要。It has been more than 10 years since the promulgation of National Defense Mobilization Law in 2010.The promulgation and implementation of National Defense Mobilization Law has brought China’s national defense mobilization work into the legal track,further improving the legal system of national defense mobilization,standardizing the exercise of national defense mobilization right,and protecting the legitimate rights and interests of citizens.However,with the rapid reform of China’s social economy,National Defense Mobilization Law has fallen behind obviously;lack of standardization and guidance,and problems such as incompatibility with the reformed military system,irregular procedures about making request and unclear compensation provisions have seriously affected the construction of China’s national defense mobilization.Therefore,to speed up the revision of National Defense Mobilization Law is urgent for the reform and development of national defense mobilization,and revision work should center closely around the civil-military integration development strategy,make a comprehensive plan to carry out overall national security concept,link up with the emergency management system,proceed synchronously with the rule of law government construction,and meet the country’s need of modern management system and management ability.
