摘 要:《反垄断法》第56条农业适用除外主体规定语义模糊,解释论难以廓清。该条蕴含着保护农业生产者和扶持农业发展双重立法目的,分别体现了竞争政策与产业政策。然从当前实践质效来看,双重立法目的不仅使条文含义模糊加剧,且滋生内在矛盾。综合《反垄断法》内在逻辑、农业现代化发展路径及域外实践经验多重因素,更宜坚持保护农业生产者这个单一立法目的,对诸如扶持农业发展、乡村振兴战略的立法目的予以舍弃。为此,建议将《反垄断法》第56条中"农业生产者及农村经济组织"的表述修改为"农业生产者及其经济组织"。Statutory provision on the subject of agricultural exemption in Antimonopoly Law has semantic ambiguity, which cannot be clarified by interpretation methods.Current provisions carry a dual purpose of “protecting agricultural producers” and “supporting agricultural development, ” respectively reflecting competition policy and industrial policy.However, the dual purpose aggravates the statutory ambiguity and has inherent contradictions.The internal logic of the Antimonopoly Law, with the path of agricultural modernization and the comparative law lessons, reveals that “protecting agricultural producers” should be the single purpose, while others should be ignored.Accordingly, this article proposes that “agricultural producers and rural economic organizations” should be revised to “agricultural producers and their economic organizations.”
