摘 要:伴随着未成年人犯罪低龄化趋势的逐渐显现与未成年人恶性犯罪比例的不断攀升,14周岁最低刑事责任年龄设置陷于一种尴尬境地,二者间的矛盾日益凸显,现有制度中对罪错未成年人教育挽救措施的缺位也造成了对这部分未成年人的实质放纵。从法律经济学的分析方法来看,降低刑事责任年龄的预期成本低于其预期收益,因此,降低刑事责任年龄势在必行。同时,还可采取法律制度变革与非正式制度变革相结合的方法来降低法律实施的预期成本。With the gradual emergence of the trend of younger juvenile delinquency and the rising proportion of juvenile delinquency, the setting of the minimum criminal responsibility age of 14 is in an embarrassing situation. The contradiction between the two has become increasingly prominent. In the existing system, the lack of education and rescue measures for the wrongful minors has also resulted in the substantial indulgence of these minors. From the perspective of law and economic analysis, the expected cost of lowering the age of criminal responsibility is lower than its expected benefits. Therefore, it is imperative to lower the age of criminal responsibility. At the same time, a combination of legal system reform and informal system reform can also be adopted to reduce the expected cost of law enforcement.
