摘  要:平台经济下,个人信用信息不仅关系到消费者隐私利益的维护,还能通过交易提升消费者消费层次、优化平台服务商绩效、发展征信产业。交易各方需求冲突可能引发消费者隐私风险、经营者绩效风险、征信产业风险等,对此隐私保护对策难以应对。我国应当遵循激励相容路径,为消费者及服务商分别设定对于信息及其处理成果的产权,鼓励二者相互转移产权,以此来确保消费者获取成果、提高交易意愿。服务商根据消费者不同层次的需求,分级分类防控隐私风险,改善成果的价格质量等交易条件;主管部门加强对平台服务商的行政指导,行业组织对服务商予以技术扶持,以此优化服务商绩效,促进产业协同发展。Under the platform economy,personal credit information is not only related to the maintenance of consumers’privacy interests,but also can enhance consumers’consumption level,optimize platform service providers’performance,and develop the credit industry through transactions.Conflicting demands of transaction parties may trigger consumer privacy risk,operator performance risk,and credit industry risk,which are difficult to cope with by privacy protection countermeasures.China should follow the incentive-compatible path and set up property rights for consumers and service providers for information and its processing results,and encourage the transfer of property rights between them,so as to ensure consumers’access to the results and increase their willingness to conduct transactions.Service providers should prevent and control privacy risks of different levels and types and improve transaction conditions such as price and quality of results in accordance with different levels of consumers’needs.Authorities should strengthen administrative guidance to platform service providers and industry organizations should provide technical support to service providers,so as to optimize service providers’performance and promote the collaborative development of platform industry.
