新《森林法》中保护优先理念应用分析

摘　　要：已通过修订的新《森林法》,与原《森林法》相比,全方位体现了保护优先的理念。新《森林法》提升了保护的地位,将天然林保护、古树名木、公益林、自然保护地、有害生物、临时占用林地恢复等内容列入了保护,扩大了保护范围,增加了与管护相关的条款,强化了保护中森林资源权利人的利益保障,明确了国家、地方政府、各级林业部门在森林资源保护中的责任,规定了社会大众、森林资源所有者、经营者应履行的保护义务,为未来生态保护和建设指明了方向。The revised Forest Law of the People′s Republic of China comprehensively embodies the concept of protection priority compared with the original forest law.The new forest law has promoted the status of protection,included the protection of natural forests,old and notable trees,public welfare forests,nature reserves,pests and restoration of temporarily occupied forest lands,expanded the scope of protection,added provisions related to management and protection,guaranteed the interests of forest resource rights holders,defined the responsibilities of the state,local governments and forestry authorities,stipulated the obligations of the public,forest resource owners and operators,pointing out the direction for future ecological protection and construction.
