摘 要:自“一带一路”倡议提出以来,我国对沿线国家,特别是东南亚国家的直接投资迅猛增长。但近年来,中资企业在东南亚国家的劳动用工过程中面临的劳动纠纷逐渐增多,不仅影响企业的生产经营,也不利于树立我国良好的投资形象。从东南亚国家的劳动力市场、劳动法律法规、劳工标准和文化风俗等要素视角,探寻影响构建和谐劳动关系的劳工风险来源,分析中资企业投资东南亚国家面临的主要劳工风险,并根据各类风险的来源、性质,按照投资前的准备阶段和投资后的经营管理阶段,分别从企业层面、政府层面提出劳工风险的防范和治理措施,可对这一问题做出回应。Since the Belt and Road initiative was proposed,China's direct investment in its bordering countries,especially Southeast Asian countries,has increased rapidly.However,in recent years,the labor disputes faced by Chinese enterprises in the process of labor employment in Southeast Asian countries are increasing,which not only affects the production and operation of enterprises,but also is not conducive to establishing a good investment image.From the perspective of labor market,labor laws and regulations,labor standards and cultural customs in Southeast Asian countries,this paper explores the sources of labor risks affecting the construction of harmonious labor relations,and analyzes the main labor risks faced by Chinese enterprises in investing in Southeast Asian countries.According to the source and nature of all kinds of risks,it puts forward measures to prevent and control labor risks from the preparation stage before investment and the operation and management stage after investment,at both the enterprise and government levels.
