党的领导法规之概念展开

摘　　要：党的领导法规从实务概念发展到学术概念,内涵有所变化。以"部门法"思维观之,领导法规专事调整党的外部领导关系,主要规范事项除了领导行为,还有领导主体、职责和保障等,因而不仅指"1+4"框架中的领导工作单行法规,还包括党章和其他三大板块党规中的领导规范。相对应的党规部门是调整党建关系的建设法规。党建关系、外部领导关系都离不开由党章及其关联法规所调整的党内领导关系。十九届四中全会所称党的领导制度涵盖建设法规和领导法规。为贯彻宪法之党的领导原则,国家法律对党的领导事项作出规定,社会规范等对领导法规进行细化。这些在党规之外的领导规范和作为党规的领导法规共同构成党的领导法体系。发展一种部门党规意义上的领导法规概念,对于发展领导法规教义学、构建部门党规体系有着积极意义。The Party leading regulations has evolved from a practical concept to an academic concept, whose connotation have changed. Getting rid of “plate”perspective and using the “department law”thinking, the leading regulations is dedicated to adjusting the external party leading relationship, including activities, subjects, responsibilities and guarantees of leadership. Therefore, it not only refers to the single leading regulations in the“1 plus 4”framework, but also includes the leading norms in the Party Constitution and other three plates of “1 plus 4” framework. The corresponding department is the Party building regulations that promotes the party building relationship. Both the party building relationship and the external party leading relationship are inseparable from the inner party leading relationship adjusted by the Party Constitution and related regulations. In order to implement the CPC leadership principles in the Constitution, state laws provide norms for Party leadership, and social norms are further refined. Al of the Party leading norms constitute the Party leading laws system. These discussions are beneficial to the development of the dogmatics of Party leading regulations and the establishment of a departmental Party regulations system.
