摘　　要："公众环境信息权即公众环境知情权"虽是目前之通说,但为有效克服公众环境知情权机制调整环境信息利益关系的局限性,有必要从公众参与环境信息流"全过程"民主治理的价值理念出发,提出"超越知情:公众环境信息权的拓展塑造"这一学术理论命题。在认可既定的公众环境信息知情权要素下,使公众环境信息权这一功能性与概括性概念在认同原有环境信息知情权这一技术性权利概念的基础上,通过必要的功能创生和有益的赋权拓展,微观塑造出一组新型的其他环境信息子权利,具体包括环境信息收集权、环境信息传播权、环境信息享益权、环境信息监督权及环境信息救济权等新兴技术性权利概念,以此完成此项学术理论命题的微观证成。Although "the right of public environmental information is the one to know public environment" is current general theory, in order to effectively overcome the limitations of the public environmental right to know mechanism in adjusting the relationship of environmental information interests, it is necessary to start the "full process" of public participation in environmental information flow. Starting from the value concept of democratic governance, the academic proposition of "beyond knowing: the expansion and shaping of public environmental information rights" is proposed. Under the recognition of the established elements of the public environmental information right to know, the functional and general concept of the public environmental information right can be created and beneficial through the necessary functions on the basis of recognizing the original concept of the technical right to know the environmental information. The empowerment and expansion of the company has created a new set of other environmental information sub-rights, including the right to collect environmental information, the right to disseminate environmental information,the right to enjoy environmental information, the right to supervise environmental information, and the right to remedy environmental information, and other emerging technical rights concept to complete the micro-justification of this academic theoretical proposition.
