“三权分置”背景下农村土地自动延包制度的构建

摘　　要：农村土地“三权分置”和第二轮土地承包期限即将到期背景下,保持农村土地承包关系长期稳定,贯彻落实好土地延包30年不变政策显得尤为重要。以舟山为例,二轮土地承包期满后,只有持续开展农业生产经营,并且承包土地主体为未消灭的村集体经济组织成员,是适格的土地自动延包主体,才能继续承包原承包地。同时,依法分类妥善解决一些特殊群体权益诉求,依法个别调整土地,鼓励长期集中连片流转、妥善解决农村土地侵权等问题,积极探索农村土地延包30年不变的具体实现形式。Under the background of the"three rights separation"of rural land and the expiration of the sec‐ond round of land contract,it is very important to keep the rural land contract relationship unchanged for a long time,and carry out the policy of land extension for 30 years.After the expiration of the second round of land contract,only the members of the village collective economic organization who continue to carry out agricultural production,management and whose land ownership has not been eliminated are the suitable main body of land automatic extension,they can continue to contract the original contracted land.At the same time,some special group rights and interests cannot be ignored,which must be properly classified res‐olution according to the law.According to reality,adjust the land individually according to law,encourage long-term centralized and continuous circulation,properly solve the problems of rural land infringement,ac‐tively explore the concrete realization form of rural land extension for 30 years.
