国家管辖范围外深海矿产资源开发利用中国方案的构建与完善——基于立法视角的探讨

摘　　要：当前,有关国家管辖范围外深海矿产资源开发利用的国际规则正在形成之中,我国应当尽快出台有关国家管辖范围外深海资源开发利用的中国方案。这既是为我国企业参与深海资源勘探开发提供法律保障的需要,也是履行我国国家担保义务、捍卫我国海洋权益的需要。针对深海矿产资源的勘探开发,我国应当构建以《深海海底区域资源勘探开发法》为基石的法规体系。在检讨我国《深海海底区域资源勘探开发法》勘探开发许可制度的基础上提出了完善我国国家管辖范围外深海矿产资源开发利用方案的具体建议。At present,the international rules on the development and utilization of deep-sea mineral resources beyond national jurisdiction are being formed,and China should issue a Chinese plan for the development and utilization of deep-sea mineral resources beyond national jurisdiction as soon as possible.This is not only the need to provide legal protection for Chinese enterprises to participate in the exploration and development of deep-sea resources,but also the need to fulfill our national guarantee obligations and defend our marine rights and interests.In view of the exploration and development of deep-sea mineral resources,China should build a legal system based on the Law on Exploration and Development of Deep seabed Regional Resources.On the basis of reviewing the exploration and development license system of China's Deep seabed Regional Resources Exploration and Development Law,specific suggestions were put forward to improve the plan for the development and utilization of deep-sea mineral resources beyond the national jurisdiction of our country.
