摘 要:法律部门定位研究的是法律的部门法归属问题,这对于法律的实施而言至关重要。由于《家庭教育促进法》在文本上没有规定一项主观公权利,没有明确法律实施的专责主管部门,以及没有界定“家庭教育工作职责”的范围,这导致对其进行法律部门定位存在困难。但是通过分析《家庭教育促进法》与教育法、婚姻家庭法和社会法的关系发现,从社会法的部门法定位对其进行认识将有助于其实施。国务院和有关部门应完善与《家庭教育促进法》相关的配套制度,回应《家庭教育促进法》的规范缺失问题,突出家庭教育指导服务、家庭教育精准帮扶和家庭教育社会治理。Legal positioning studies the attribute of law,or the destination of legal departments,which is very important for the implementation of law.Because the Family Education Promotion Law does not stipulate a subjective public right in the text,specify the special competent department for law implementation,or define the scope of"family education work responsibilities",it is difficult to locate it legally.However,by analyzing the relationship between Family Education Promotion Law and education law,marriage and family law and social law,it is found that understanding it from the orientation of social law will contribute to its implementation.In the future,the State Council and relevant departments should improve the supporting systems related to the Family Education Promotion Law,response to its lack of norms and highlight family education guidance services,precise assistance to family education and social governance of family education.
