摘　　要：饮用水卫生安全直接影响着人的健康。随着中国的发展,许多城市暴露出饮用水安全问题。造成饮用水安全问题频发的原因很多,迫切需要政府领导各相关行政部门加以解决。我国现存的涉及城市生活饮用水安全保障的立法不完善,上位法规定过于片面,没有生活饮用水的专门立法,地方性立法易产生冲突,监管主体之间权责不清,水源地监管、水质监管等制度均有待完善。通过研究国外相应的法律制度,美国、日本、英国等国家在饮用水安全方面相关立法较为完善,经验丰富。结合我国国情,在完善饮用水安全立法方面,应出台《饮用水安全法》,规范地方性立法,明确政府各部门权责划分,健全水质监测、水源地监测及安全预警应急管理制度。全面提高城市生活饮用水安全保障法律制度,城市人口的健康和城市的高速发展才能得以保障。The safety of drinking water has a direct impact on people’s health.With China’s development,many cities are exposing problems in drinking water safety.There are many reasons for the repeatedly occurring drinking water safety incidents,and the government is in sore need of a solution which can be figured out through the assistance of relevant administrative departments.China’s existing legislation related to the city drinking water is not perfect:the upper laws are too one-sided,the lack of specific legislation,the commonly seen conflicts between local legislations,the fuzzy responsibilities for supervisors,the water-quality monitoring and other supervision systems to be improved.Through the study of the relevant foreign law rules for drinking water safety,the legal system in countries like the United States,Japan,and the United Kingdom are relatively perfect.Combined with China’s current situation,in the aspect of improving our legal system in drinking water safety,the drinking water safety law should be promulgated,the local legislation should be standardized,the division of powers and responsibilities of various departments should be clarified,and the water quality monitoring,water source monitoring and both warning and emergency management system should be improved.Only by all-round improvement of the legal system can urban population’s health and the city development be guaranteed.
