摘　　要：在我国《监察法》明确规定监察赔偿制度后,《监察法实施条例》第二百八十条、第二百八十一条进一步规定了监察赔偿的归责原则、适用情形、赔偿请求人、赔偿义务机关等,使得监察赔偿制度具有了可操作性,要依据体系解释的方式对这些规则予以适用。但现行监察赔偿规则相对于实践需求还存在制度供应不足。为实现规范和制约监察权的目标,未来需进一步完善监察赔偿的具体赔偿内容、程序、救济途径等。监察赔偿属于独立的国家赔偿类型,在监察法律体系中确定与监察体制相对应的监察赔偿规则,同时对《国家赔偿法》作相应的修改:确立监察赔偿的基本原则,对《监察法》《监察法实施条例》不宜大篇幅涉及的规则进行规定。After China’s Supervision Law clearly stipulates the supervision compensation system,articles 280 and 281 of the regulations on the implementation of the supervision law further stipulate the imputation principle,application situation,compensation claimant and compensation obligation organ of supervision compensation,making the supervision compensation system operable.These rules should be applied according to the way of system interpretation.However,compared with the practical demand,the current supervision and compensation rules still have insufficient system supply.In order to achieve the goal of standardizing and restricting the supervision power,it is necessary to further improve the specific compensation contents,procedures and relief ways of supervision compensation in the future.Supervisory compensation is an independent type of state compensation.In the supervisory legal system are determined the supervisory compensation rules corresponding to the supervisory system.At the same time,the state compensation law is amended accordingly so that the basic principles of supervisory compensation are established,and the rules that should not be covered at great length in the Supervisory Law and its implementation regulations are stipulated.
