摘 要:目前,中国燃气设施共有部分维护费用分担没有明确法律规定,在燃气设施维护费用日益增长的情况下,燃气设施安全维护费用难以通过现有制度予以解决。参考中国香港、美国、日本、韩国的城市燃气企业在燃气设施安全维护权责和费用分担方面的经验,借鉴中国相关公共事业公司的做法,中国燃气设施安全维护费用分担问题既要从法律、价格、监管体制上有所突破,也应遵照成本分担、利益共享的市场原则,并提出4种居民燃气设施安全维护费用的分担方案。只有明晰产权归属和维护责任以及费用分担机制,才能破除燃气设施安全维护困境,实现居民燃气使用安全和中国城市燃气行业的健康发展。At present,there are no clear legal provisions on the allocation of maintenance costs for the common part of gas facilities in China. With the increase of maintenance costs of gas facilities,it is difficult to solve the safety maintenance costs of gas facilities through the existing system. Referred the practices of Hong Kong in China,the United States,Japan,South Korea’s city gas enterprises in fuel gas facilities security maintenance experience responsibilities and costs,the problem of fuel gas facilities security maintenance treatment should not only a breakthrough from the legal,price,regulatory regime,but also be in accordance with market principles of cost sharing and shared interests by drawing lessons from the practice of domestic related utilities. It also puts forward such four kinds of schemes to share the cost of safety maintenance of residential gas facilities. The dilemma of gas facility safety maintenance only can be solved by clarifying the ownership of property rights,maintenance responsibility and cost sharing mechanism,to realize the safe use of gas by residents in China and the healthy development of urban gas industry.
