摘 要:《奥林匹克标志保护条例》(2018修订)加强了对奥林匹克标志的保护,适应了筹办2022年北京冬奥会的需要,但在立法位阶、保护范围、侵权认定、法律责任等方面还存在诸多不足之处。对此提出,一要提高立法位阶,制定《奥林匹克标志保护法》;二要扩大保护范围,将域名、境外举办的奥运会相关标志、特定指向性的文字组合纳入保护范围;三要细化侵权认定,引入“混淆可能性”作为奥林匹克标志侵权判定的核心要素,具体化隐性营销的侵权认定,增加合理使用条款;四要完善侵权、行政与刑事3种责任的具体内容和责任衔接问题;五要构建多部门联合监管以及增加禁令、仲裁作为救济手段。China’s Regulations on the Protection of Olympic Symbols(revised in 2018)strengthens the protection of Olympic symbols and meets the needs of preparing for the 2022 Beijing Winter Olympic Games.However,there are still many deficiencies in the legislative level,scope of protection,identification of infringement and legal liability.Therefore,the following points are proposed.Firstly,we should raise the level of legislation and formulate the law on the protection of Olympic symbols.Secondly,we should expand the scope of protection which includes domain names,symbols related to overseas Olympic Games and specific directional text combinations.Thirdly,we should refine the identification of infringement,introduce“confusion possibility”as the core element of the identification of Olympic logo infringement,concretize the identification of infringement of implicit marketing,and increase the terms of fair use.Fourthly,we should improve the specific content and responsibility connection of tort,administrative and criminal liability.Finally,we should build multi sectoral joint supervision and increase injunction and arbitration as relief means.
