党内法规推进宪法实施的逻辑理路——以中央党内法规为对象的考察

摘　　要：将党内法规纳入社会主义法治体系的当下,党内法规不仅是管党治党的利器,还是建设社会主义法治国家的重要保障。党内法规尤其是中央党内法规推进宪法实施具有正当性和可行性,通过从严治党推进党的建设进而促进宪法实施,部分党内法规对国家法律的出台和完善具有先导性作用。党内法规推进宪法实施的方式包括在党内法规中直接规定宪法内容和间接体现宪法内容两种,并呈现出集中于宪法序言和总纲、积极实施和消极实施并存以及以义务性规定为主等特征。今后,为了充分发挥党内法规在宪法实施上的作用,应当明确党内法规实施宪法的范围与限度,提升党内法规的立规质量,注重党内法规和国家法律的衔接与协调,加强对党内法规的合宪性审查。At the moment when inner-party regulations are brought into the socialist rule of law system,inner-party regulations are not only a tool for managing the party,but also an important guarantee for building a socialist country under the rule of law.Inner-party regulations,especially the central inner-party regulations to implement the Constitution has legitimacy and feasibility,through strict administration of the party to promote party building and then promote the implementation of the Constitution,some inner-party regulations play a leading role in the introduction and improvement of national laws.The ways of implementing the constitution by inner-party regulations include stipulating the constitutional content directly and indirectly reflecting the constitutional content in the inner-party regulations,and showing the characteristics of focusing on the preface and general program of the constitution,the coexistence of positive and negative implementation,and giving priority to compulsory provisions.In the future,in order to give full play to the role of inner-party regulations in the implementation of the Constitution,we should clarify the scope and limits of the implementation of the Constitution,improve the quality of inner-party regulations,and pay attention to the connection and coordination between inner-party laws and national laws.strengthen the constitutional review of inner-party regulations.
