“制度借用”与“情理借用”:政策变通的运作逻辑

摘　　要：本文以S开发区征地拆迁为个案,对民众在征迁实施过程中的实践策略、民众在征迁政策变通中的作用,以及政策变通背后的社会结构条件进行了揭示和呈现研究发现,民众为了提升补偿利益而进行利益的表达,对既有的政策制度进行借用;开发区为了回应民众的议价策略以完成征迁任务,对既有的情理规则进行借用;民众和开发区两方的实践交互使得政策变通得以生产出来传统规则和现代规则并存的转型期的乡土社会构成政策变通运作的社会基础,而情理观念下关系取向的具有相对性特质的正义认知构成其运作的价值基础.Taking land acquisition and demolition in S Development Zone as a case, this article reveals and presents the people’s practical strategies in the implementation of the expropriation and resettlement, the role of the people in the policy changes, and the social structural conditions behind the policy changes. The study found that the public borrowed existing policies and systems in order to enhance compensation benefits to express their interests;in order to respond to the public’s bargaining strategy to complete the task of requisition and relocation, the development zone borrowed the existing rules of reason, the practical interaction between the two parties has enabled policy flexibility to be produced. The rural society in the transition period where traditional rules and modern rules coexist constitute the social foundation for the flexible operation of the policy, and the justice perception of the relationship orientation under the concept of reason constitutes the value basis for its operation.
