摘　　要：辩辞是吐鲁番出土公文文书的一类,其内容多为案件审理时审问者和申辩者之间对话的官方记录,具有较高的文献价值。学界目前对辩辞的研究多聚焦于对其法律规范、修辞方式的个案考察。从整体上对吐鲁番出土辩辞进行系统梳理,厘清辩辞的内容和行文特点,据此考察吐鲁番地区的法律观念、商业活动等,对于了解中古时期吐鲁番社会风貌具有一定的意义。The rebuttal is a typical representative of the official documents unearthed from Turfan.Its con⁃t ent is mostly the official record of the dialogue between the interrogators and the defenders in the trial of the case,which has high literature value.At present,the study of debate is focused on the case study of its legal norms and rhetoric.On the whole,this paper systematically combs the unearthed arguments docu⁃m ent of Turfan and clarifies the contents and writing characteristics of the arguments,and examines the le⁃g al concepts and commercial activities of the people in Turfan area,which is of certain significance for un⁃d erstanding the social features of Turfan in the Middle Ancient period.
