国际文化遗产法视域下的非遗保护国际标准--兼评我国《非物质文化遗产法》

摘　　要：结合国际文化遗产法这一领域的兴起并基于《保护非物质文化遗产公约》,文章提出非遗保护的国际标准问题,即“人权”“相互尊重”和“可持续发展”要求。因应非遗传承以人为依托的特点,这三项国际标准之于非遗保护的意义分别指向人的本体、人际关系和代际关系。《非遗公约》丰富的国家实践已表明,尊重人权是公约各项原则的根本,相互尊重是具有根本性地位的基本原则,可持续发展是非遗保护工作的行动目标。“十四五”规划已将非遗保护列为我国国家总体战略的重要组成部分,2021年适逢我国《非物质文化遗产法》实施十年以及《非遗公约》生效十五年,重视《非遗公约》的解释问题并使之与我国法律进一步对接具有明显的现实意义。With the rise of the international cultural heritage law,plus the promulgation of UNESCO Convention on Intangible Cultural Heritage Protection,this article proposes the issue of international criteria for intangible cultural heritage protection,that is,human rights,mutual respect,and sustainable development.Due to the human-center characteristic of intangible cultural heritage,these three international criteria respectively point to the nature of human,interpersonal relationship,and intergenerational relationship in terms of intangible cultural heritage protection.Abundant state practices of UNESCO Convention have shown that human rights have been the fundamental rule of all principles in the Convention,mutual respect has been the fundamental principle,and sustainable development has been the action goal.In the 14th Five-Year Plan,intangible cultural heritage protection has been listed as an important part of China's overall national strategy.The year of 2021 is the 10th anniversary of the implementation of China's Intangible Cultural Heritage Protection Law and the 15th anniversary of the implementation of UNESCO Convention,and it is of obvious practical significance to attach importance to the interpretation of the UNESCO Convention on Intangible Cultural Heritage Protection and to promote its further connection with the law in China.
