基于土地新政的提升农民征迁利益途径探讨——以Zh市J村征迁改造为例

摘　　要：城中村改造是城市更新的重要内容,是政府治理和村民自治相互交织的过程。本文在回顾J村城中村改造过程的基础上,提出农民征迁利益分配的两阶段模型:征迁前期利益的初次分配和征迁阶段利益的再分配,提升农民征迁利益最重要的阶段在征迁前期阶段。本文通过分析政府主导、政企合作的土地一级市场征迁过程,提出提升农民征迁利益途径的探讨:政府主导土地一级市场,开发商退出前期介入;规范土地征收前期工作程序,确保农民参与权和听证权实现;依照征地片区综合地价进行补偿,逐步提高补偿标准;提供专业救济,改善农民弱势群体地位。The reconstruction of urban villages is an important part of urban renewal,it’s a process of interweaving government governance and villager autonomy. On the basis of reviewing the reconstruction process of urban village in J village,the paper proposes a two-stage model for the distribution of benefits of peasants’ expropriation:the initial distribution of benefits in the early stage of expropriation and the redistribution of benefits in the stage of expropriation, the most important stage to improve the benefits of peasants’ expropriation is in the early stage. In accordance with the newly revised Land Administration Law of the People’s Republic of China on Standardizing the procedures of land expropriation,perfecting the land expropriation and multiple safeguard mechanism, the paper analysis the factors which influence the benefits of peasants’ expropriation in the government led and government enterprise cooperation land acquisition and demolition mode,then,the paper puts forward some strategic suggestions to enhance the interests of peasants,such as the government dominates the primary land market and the developers withdraw from the pre intervention;Standardize the preliminary work procedures of land expropriation to ensure the realization of peasants’ right of participation and right to be heared;Compensating according to the comprehensive land price of the land acquisition area and gradually improving the compensation standard;Providing professional relief and improving the status of vulnerable groups of peasants.
