法经济学视角下我国农村金融扶贫的立法设计

摘　　要：作为均衡扶贫资源的调节器,金融扶贫在区域扶贫攻坚,特别是在农村扶贫攻坚中的作用日益显著。但因金融扶贫自身存在诸多风险和不稳定性等特点,必须制定完善的立法机制予以规范。鉴于我国目前金融扶贫法律法规欠缺的现状,农村金融扶贫立法设计这一问题迫在眉睫。因此,运用法经济学原理分析农村金融扶贫,尝试以立法的成本—收益分析和立法的供给—需求分析为依托,通过立法原则、立法体系等方面,解析农村金融扶贫的理论基础与实践经验。同时,以法学与经济学交叉为视角,对我国农村金融扶贫立法做出跨学科研究,一方面从内在逻辑强调农村金融扶贫立法设计的重要意义,另一方面立足于农村金融扶贫的现状,以求探索我国农村金融扶贫的立法路径。As a regulator of balanced poverty alleviation resources,financial poverty alleviation plays an increasingly prominent role in regional poverty alleviation,especially in rural poverty alleviation.However,due to the inherent risks and instability of financial poverty alleviation,it must be regulated by a complete legislative mechanism.In view of the current lack of financial poverty alleviation laws and regulations in China,the design of rural financial poverty alleviation legislation was an urgent issue.Using the principles of law and economics to analyze rural financial poverty alleviation,try to analyze the theoretical basis and practical experience of rural financial poverty alleviation through legislative principles and legislative systems based on the cost-benefit analysis of legislation and the supply-demand analysis of legislation.At the same time,from the perspective of the intersection of law and economics,an interdisciplinary research on China's rural financial poverty alleviation legislation was made.On the one hand,it emphasized the importance of the design of rural financial poverty alleviation from the internal logic.On the other hand,based on the current situation of rural financial poverty alleviation,China was aimed to explore the legislative path of poverty alleviation in rural finance.
