摘 要:自进入数字化时代以来,人们接触艺术作品的方式越来越丰富。2001年《著作权法》为录音制作者新增了信息网络传播权,以应对传播方式变化带来的挑战。与《著作权法》相比,新《著作权法》值得关注的要点之一是引入录音制作者“二次获酬权”的条款。文章针对新《著作权法》引入录音制作者“二次获酬权”的条款所面临的问题进行探究认为,扩大录音制作者的权利并非解决当前问题的关键办法,新增了二次获酬权也未必能满足唱片产业呼吁扩权的要求。Since the advent of the digital era,people have become increasingly exposed to art works.The 2001“Copyright Law”added the right to information network communication for recording producers to address the challenges posed by changes in communication methods.Compared with the former law,one of the noteworthy points of the new law is the introduction of the“secondary remuneration right”clause for recording producers.The article explores the problems faced by the new clause in practice.It is believed that expanding the rights of recording producers is not the key solution to the current problem,and the newly added right of secondary remuneration may not necessarily meet the recording industry’s call for rights expansion.
