摘　　要：警察行政强制措施是警察实现其行政目的的必要手段。强制措施“善”“恶”共存的内在特质,以及执法实践中违法失范和强制缺位共存的现状,都使我们应从保护警察权和限制权力并重的视角来审视警察强制措施的制度建设和实践,并从法律层面、实践层面的机制探索警察强制措施的规制路径,使其在法治轨道最大限度地发挥作用。Police administrative coercive measures are necessary for the police to achieve their administrative purposes.The inherent characteristics of coexistence of“good”and“evil”of coercive measures,as well as the coexistence of illegal misconduct and lack of coercion in law enforcement practice,make us examine the institutional construction and practice of police coercive measures from the perspective of protecting police power and limiting power at the same time,and explore the path of regulation of police coercive measures from the legal and practical levels.We should explore the regulatory path of police coercive measures from the legal level and the mechanism at the practical level to function to the maximum extent in the rule of law track.
