论大数据时代个人信息的私法保护与共享

摘　　要：欧盟和美国分别基于人格尊严和个人自由理念保护个人信息,以保护人的基本权利和实现个人自治,其理论本源为个人本位下的个人控制论。个人本位过于关注个人信息蕴含的个人权益,并未充分考量个人信息的公共性和社会性。作为数据类型的一种,个人信息亦具有数据的本质特性,即流通性,数据只有在流通中方可实现价值,个人信息既与个人的人格权益联系密切,又与他人和社会利益相关。个人本位和社会本位均为权利本位的存在形式,前者是第一阶段,后者是第二阶段,与大数据时代契合的是社会本位。我国应在社会本位下考量个人信息的私法保护与共享,区分个人信息中的敏感信息和非敏感信息的处理规则,平衡个人权益和社会公共利益,实现权利本位第二阶段的个人信息保护转型。the European Union and the United States protect personal information based on the concepts of human dignity and personal freedom respectively,in order to protect people's basic rights and realize personal autonomy.Their theoretical origin is the personal cybernetics under the personal standard.The personal standard pays too much attention to the personal rights and interests contained in personal information,and does not fully consider the publicity and sociality of personal information.As a kind of data type,personal information also has the essential characteristics of data,that is,circulation.Data can realize value only in the circulation.Personal information is not only closely related to personal rights and interests,but also related to the interests of others and society.Both individual standard and social standard are forms of rights standard.The former is the first stage and the latter is the second stage.What fits in with the era of big data is social standard.China should consider the private law protection and sharing of personal information under the social standard,distinguish the processing rules of sensitive information and non sensitive information in personal information,balance personal rights and interests and social public interests,and realize the transformation of personal information protection in the second stage of the right standard.
