摘 要:自动取得制度作为国际公认的著作权基本确权规则,内含权属待定的天然缺陷。在新技术应用带来创作和传播方式的大变革中,自动取得制度的缺陷放大了著作权纠纷风险,造成了著作权案件高发。在当前不宜根本改变自动取得确权制度的前提下,合理利用区块链和人工智能技术弥合制度公信力缺陷,以改进自动取得制度,有助于明确权属以减少权属纠纷,规制抄袭以避免权属混淆,进而减少著作权案件的发生。The automatic acquisition system,as an internationally recognized rule for the basic determination of copyright,contains the natural defect that the ownership has yet to be determined.In the great change in the way of creation and communication brought about by the application of new technology,the defect of automatic acquisition system magnifies the risk of copyright disputes,resulting in a high incidence of copyright cases.Under the premise that it is not suitable to fundamentally change the system of automatic acquisition of rights,we should make rational use of block chain and artificial intelligence technology to bridge the defects of credibility of the system,so as to improve the system of automatic acquisition,which is helpful to clarify ownership to reduce disputes of ownership,regulate plagiarism to avoid confusion of ownership,and then slow down the occurrence of copyright cases.
