摘　　要：一般地,要做到熟练、全面、追新、精准地把握现行民法规范,我们不仅需与时俱进地对形式民法规范、实质民法规范及相应的程序法规范了如指掌,而且要能透析这些规范背后的立法旨趣。在具体的解释适用过程中,需精通民法的技术分析:准确地定性法律关系、有层次地适用;也需深悟技术背后人间的普适性价值和情感:后者可帮助我们定性法律关系、进行狭义法律解释或填补漏洞,甚至矫正民法实在规定。既对其充满敬畏,也内心温柔地寻找、解释、适用、发展民法规范和法理,我们就能成为理性而有温度的民法人。In general,to grasp the norms of civil law skillfully,wholly,and precisely,we not only need to master the formal civil law norms,substantive civil law norms and the corresponding procedural law norms over time,but also to be able to analyze the legislative objective behind these norms.In the process of specific interpretation and application,it is necessary to be proficient in technical analysis of civil law:determine the nature of legal relations accurately,apply laws hierarchically;it is also necessary to deeply understand the universal value and emotion behind the technology:the latter can help us determine the nature of legal relations,interpret laws in a narrow sense or fill loopholes,and even correct the substantive civil law norms.We behold with awe,and also gently find,interpret,apply,and develop civil law norms and legal principles,so that we can become a rational and warm specialist in civil law.
