强奸未成年人犯罪的量刑结构实证分析:问题与优化

摘　　要：强奸未成年人犯罪的宣告刑整体高于强奸成年人,但对标阶层式量刑要求还存在量刑结构失衡问题。根据SPSS检测,当前强奸未成年人犯罪的宣告刑与其年龄阶层无显著相关性,原因在于量刑情节适用不充分以及起点刑跨度太大。因而必须准确归类并充分适用各种量刑情节、限缩起点刑的跨度,在强奸幼女犯罪中补足对犯罪人曾犯罪、被害幼女特殊心智、暴力之从重适用,在强奸已满14周岁未成年人犯罪中,补全被害人特殊心智、多次强奸之从重运用。The condemnation of gaping the immaturity is higher than the maturity in whole.But there is a gap before the standard of rape in criminal law,which asks for the correspondence of the age stage and protection range. SPSS disclose there is no significance relation between the condemnation and age stage.So we should classify scientifically and application fully all the adjusting circumstances, and to limit the starting penalty margin. Especially the Judicial should make up the heavier punishment in gaping the young girl by the circumstances of recidivism, of drawback mind in these girl, and of gaping by violence;and in gaping these immunity above 14 by the circumstances of drawback mind and gaping repeatedly.
